US-CHINA TRADE WAR

“section 301”

What is Section 301?

The US Trade Act of 1974 contains a provision found in section 301 that authorizes the President to take all appropriate Action, to remove any burden placed by a foreign government to restrict US Commerce. Section 301 investigations can be initiated by the United States Trade Representative (USTR) or by a petition from a firm or industry group.

Currently, when the term “Section 301” is used it is primarily referring to the USTR initiated investigations into Chinese trade practices.  All the information on this page deals with what is commonly referred to as the US-China Trade War.

How can Customs Gurus Help you?

You may be paying too much!

You could be over-paying section 301 duty if you have never had your imports reviewed by a licensed customs broker. In-fact, there are MANY exclusions that have been granted by the USTR at the request of the importing community that apply to ALL importers not just the company that submitted the request. A refund can be requested for all imports that have exclusions up to 180 days past liquidation of the entry. This means possibly a year and a half AFTER the import you can still get your money back!

We can find refund opportunity

Customs Gurus can look through your past imports and find refund opportunity based on exclusions that have been approved since you imported your product.

We can file your refund requests

Customs Gurus can file refund claims on your behalf even if we are not the customs broker who filed your entries.

We can file your exclusion requests

Customs Gurus can file an exclusion request on your behalf if you think it is unfair that you are paying duty on imported product from China. An example is if you are importing from China because there are no US sources of the product available then China’s trade practices cannot possibly be harming US Commerce and it is likely the USTR will agree and issue an exclusion for your product.

We can analyze your classification data base

Customs Gurus can review your HTS classifications and make sure that you did not over-pay because your product was incorrectly classified.
