Entry Process


Importer Registration

 

All parties wishing to import to the US must be registered with CBP on Customs Form 5106. Most companies use their Taxpayer Identification Number and individuals use their Social Security Number to register. If they are not available, an importer can requests a Customs Assigned number. Customs Gurus will walk you through this step and file your 5106 electronically through ACE.


Import Bonds

 

US Customs requires all imports be secured by a bond. Customs Gurus will query your importer number to determine if you already have a bond. If a bond is required we will calculate the liability amount necessary for your situation and arrange the purchase of the bond on your behalf.


Documents

 

Documents are required to show evidence of the right to make entry and support the declarations that are made to Customs. Customs Gurus will discuss documentation as needed and collect what is needed for the entry so that it can be stored with the entry and provided to Customs on demand. Some examples of documents are a bill of lading, commercial invoice, packing list, certificate or origin, although the nature of your import may require some other agency documentation.


HTS Classification

 

Each article imported to the United States must be classified within the harmonized tariff schedule (HTS). The HTS is used to quickly assign duty rates, identify possible other agency regulations, and standardize descriptions so Customs can identify what is being imported. Each importer is responsible for correctly classifying their products. We will use an HTS you provide us, assist you with your decision, or when needed review your entire data base.


Entry Filing

 

Once all the documents are collected, the import regulations reviewed, and the freight arrived in the US, Customs Gurus transmits your entry electronically to CBP for clearance. This will result in a Customs form 3461 (cargo release) and 7501 (entry summary) being prepared. Your shipment will either be given the green light so you can collect your freight, or CBP may request further information, possibly even an exam. The entry process is complete when duty is paid.


Exams

 

In the event your freight is selected for an exam, Customs Gurus will be you partner and liaison to the CBP officers conducting the exam. We will coordinate with your freight forwarder or local truckers to coordinate the exam as needed. The secret to exam success is proper preparation before importation.


Corrections

 

Mistakes happen, new information appears late, or laws change. Fortunately, Customs Gurus can file Post Summary Corrections and Protests to correct almost all of them. A great example is the current trade war. Many importers paid huge amounts of duties at time of entry and the US Trade Representative later excluded a large number of products from the additional tariffs back to the date of original implementation. This means entries can be corrected and importers can recoup the duty they over-paid.
